Driving with headphones and earbuds is usually illegal, regardless of type.
When I got my first 1960's driving lesson, on being handed the keys, the instructor said, "a car is more deadly than a bullet, always remember that".
If hit by a driver wearing headphones, I'd bet many people would get it in the police report and sue.
